Terms of Service

The short version
PivotProof generates opinionated, hostile feedback on your startup idea using an AI panel. Take what's useful, ignore what isn't. We provide a tool; you make the business decisions and bear the consequences.
1. The agreement
These Terms of Service ("Terms") are a binding agreement between you and PivotProof ("we," "us"). By creating an account or buying credits, you agree to these Terms. If you don't agree, don't use the service.
2. The service, plainly
- You submit a startup idea. We feed it to five AI personas (VC, skeptical customer, competitor, domain expert, devil's advocate). They respond with critique, a 0–100 Pivot Score, kill criteria, and a traction checklist.
- Each completed report consumes one credit. Credits are purchased in packs and do not expire.
- Reports are generated by large language models (currently Anthropic's Claude). They are opinionated, sometimes wrong, and never a substitute for real customer discovery, financial diligence, or legal advice.
3. What you must not do
- Use the service for anything illegal, fraudulent, harmful, or designed to defame a real person or business.
- Submit ideas containing confidential information you do not have the right to share. We process submissions through third-party AI APIs.
- Resell, sublicense, white-label, or scrape the service without a written agreement.
- Attempt to reverse-engineer the prompts, extract personas, or use the outputs to train a competing model.
- Share your account credentials. One human per account.
4. Payments, refunds, and credits
- Credits are billed in USD via Stripe. Prices are listed on
/pricingand may change with 30 days' notice for new purchases (existing credits are honored at the price you paid). - Refunds: if a report fails to generate due to our error, we will refund the credit automatically. Beyond that, all sales are final once a report has been generated. If you have a billing concern, email info@pivotproof.org within 14 days and we'll work with you.
- Credits are non-transferable between accounts (Teams plans allow seat sharing within a single team).
5. Your content
You retain all ownership of the ideas you submit and the reports we generate for you. By using the service, you grant us a limited license to process your submissions through the third-party APIs needed to generate your report. We do not claim ownership of your content and do not use it to train AI models.
If you choose to make a report public via the share-link feature, that content becomes accessible to anyone with the link, including search engines. You can unshare at any time.
6. AI output disclaimer (read this one)
The reports are generated by AI. They will sometimes be wrong, biased, confidently incorrect, or based on outdated training data. They are intended as a thinking tool, not a final verdict.
- Do not rely on PivotProof reports as the sole basis for any business, legal, financial, or hiring decision.
- We make no warranty that any specific persona reflects the actual views of any real person, even if a real name is referenced.
- We are not your lawyer, accountant, investor, or therapist.
7. Account termination
You may delete your account at any time from /settings or by emailing info@pivotproof.org. We may suspend or terminate accounts that violate these Terms, abuse the service, or charge back legitimate purchases. Outstanding credits in a terminated account are forfeit unless the termination was due to our error, in which case we refund them.
8. No warranties
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred US dollars. We are not liable for indirect, consequential, incidental, or punitive damages, including lost profits, lost revenue, or business interruption.
10. Indemnification
You agree to indemnify and hold us harmless against any claim arising from your misuse of the service, your violation of these Terms, or your infringement of any third-party right.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email to the address on your account at least 14 days before taking effect. Continued use after the effective date constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Delaware.
